HOA Current Guideline for front yard maintenance
This closely follows San Marcos Ordinances.
Ground Cover Requirements: The Property can’t have a lack of vegetation, lawn, shrubs or other decorative ground cover on any improved property when compared to other properties in the surrounding neighborhood so as to cause dust, erosion or the accumulation of debris.
Lawn Standard: Properties can’t have lawn areas and ground cover that is dead and/or exceed a height of six (6) inches from grade: or lacks plant material necessary to prevent erosion or prevent an unsightly landscape appearance that contributes to conditions that cause blight and property degradation. Ornamental grasses that exceed six (6) inches in height are exempt.
Trees and other Vegetation: Dead or hazardous trees and other vegetation that are unsightly or dangerous to the public health, safety and welfare, or contributes to blight and property degradation is not allowed. All weeds, dry grasses, dead shrubs and trees are considered a public nuisance.
Overgrown Vegetation Definition : Overgrown vegetation likely to: harbor rats, vermin and other nuisances dangerous to public health; cause a detriment to neighboring property, contribute to conditions that cause blight and property degradation, or grow into the public right-of-way such that is obstructs the view of the drivers on public streets or private driveways, or substantially obstructs the use of a public sidewalk area.

Maintenance Assessments
The assessments levied by the association shall be used exclusively to promote the recreation, health, safety and welfare of the residents in the properties and for the improvement and maintenance of the common area.
Both annual and specials assessment must be fixed at a uniform rate for all lots.
Architectural Control
No Building, fence, wall or other structure shall be commenced, erected or maintained upon the Properties, nor shall any exterior addition to or change of alteration therein be mad until the plans and specifications showing the nature, kind, shape, height, materials and location of the same shall have been submitted to and approved in writing as to harmony of external design and location in relation to surrounding structures and topography by the Board of Directors of the Association, or by an Architectural Control Committee composed of up to three (3) Representatives appointed by the Board, or its designated committee, fails to approve or disapprove such design and location within thirty (30) days after said plans and specification have been submitted to it, approval will not be required and this Article will be deemed to have been fully complied with.
Use Restrictions
A member can’t use a lot or common area for business, commercial, manufacturing,
mercantile, storing or vending.
No sign of Billboards of any kind shall be displayed to pubic vision on lot or properties except
for a lot advertising sale, lease or rent of signs allowed by city or state laws.
No activity shall be done on lot of common are or properties that may become an annoyance
or nuisance to the neighborhood or to quite enjoyment of the neighborhood by others. Examples :
continuous dog barking, loud music, parities.
Need minimum of three board members to determine an annoyance or nuisance.
No temporary covering of enclosure shall be placed in front yard in public view. You can’t use
the temporary structure for a living space or residences. You can’t modify or convert your garage that
prohibits it’s use as a two car garage.
Place you trailer, camper, boat, etc. in your garage or fenced rear or side yard. Same for a
vehicle that is inoperable, in poor mechanical condition or detrimental to the neighborhoods
appearances. Determination is at the discretion of the board of directors on a basis of personal
observation and information from members of the community.
You cannot raise, bred or keep animal, livestock or poultry on any Lot, except dog, cat or
other household pets.
No dogs are allowed in the Common Area unless under the Control of the dog owner. Dog
owners are liable for the dog(s) whether under their control, on a leash or otherwise restrained.
Exterior antenna (tv, radio, or other) is permitted only with the written approval of the
Architectural Control Committee.
No oil drilling or mining allowed.
All rubbish, trach and garbage shall be regularly removed from the Properties, and shall not
be allowed to accumulate thereon. All clotheslines, refuse containers, woodpiles shall be prohibited
upon any Lot, unless obscured from view of adjoining Lots, Common Area and streets by a fence or
appropriate screen approved by the Architectural Control Committee. Trash and Recyclable containers
placed curbside need to be brought in within a 24 hour period after pickup.
